Full Terms and Conditions

  1. CONTRACT: The Contract for a short-term holiday rental will be between the owners of Burnbank Lodges (referred to as “us” or “we”) and the person making the booking and all members of the holiday party (referred to as “you”, “your”, “guests”) under the following booking conditions. Scottish law will govern the Contract. The Contract will be subject to these booking conditions, and must be complied with. The person whose name is on the booking form (referred to as the “Responsible Person”) agrees to take full responsibility for ensuring that all the following Terms and Conditions are adhered to by all members of the party. The Responsible Person must personally stay at the accommodation throughout the holiday and be at least 21 years of age at the time of booking. All members of the party must be aged 21 or over. The names, addresses and ages of all members of the party must be shared with the owners on request.
  2. PURPOSE OF HIRE: The Hirer accepts that the letting is a holiday let to which Section 12(2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988 apply, namely, “a tenancy the purpose of which is to confer on the tenant the right to occupy the house for a holiday.”
  3. SUB-LETTING: The Hirer may not sub-let the hired premises or any part thereof.
  4. OCCUPANCY: The number of people occupying the hired premises must not exceed two. The Owners’ insurance is invalidated if the occupancy is greater than two in which instance the owners retain the right to refuse admission or require the Hirer and their party to leave.
  5. CHILDREN: Children are not permitted to stay in the lodges. There is a minimum age policy of 21 for all guests. If the Hirer arrives with children the owners will exercise their right to require the Hirer and their party to leave and their stay will be void and non-refundable.
  6. PERIOD OF HIRE. The hired premises will be available for occupancy from 4pm on the day of arrival and must be vacated by 10am on the day of departure.
  7. CHECKING IN: The Hirer is required to check in on the day of arrival from 4pm unless by prior arrangement.
  8. ACCURACY OF DETAILS: The brochure and website are as accurate as possible but cannot be warranted, nor do the descriptions form any contract. Whilst every effort is made to ensure accuracy of property descriptions and images, the facilities and services may alter. We reserve the right to alter or improve any of the subjects without notice.
  9. PAYMENT: For bookings made directly with Us, a non-refundable 25% deposit will be payable at the point of making the booking. The remaining balance will be due 30 days before the arrival date. The owners retain the right to treat the booking as cancelled if the outstanding balance due is not received by that time.
  10. CANCELLATION: In the event that a let booked directly with Us is cancelled and that notice in writing is received by the start of 30 days prior to the commencement of the let, the deposit will be retained but no further charges are due. If notice is received later than the start of 30 days prior to the commencement of the let, 100% of the balance will be due. In exceptional circumstances, and at the Owner’s discretion, it may be possible to reschedule the stay for an alternative time, subject to availability. Even when holidaying in your own country we strongly recommend the purchase of suitable holiday cancellation insurance.
  11. BOOKINGS MADE THROUGH A THIRD PARTY: Bookings made via third party travel agents may have different booking and cancellation policies to those listed above.
  12. “FORCE MAJEURE” (circumstances beyond the control of the owner): If for any reason we have to cancel your booking in advance due to circumstances beyond our control for example fire, flood, exceptional weather conditions, epidemics, destruction/damage to the property (“force majeure“) you will be refunded the full amount of the booking. If we have to terminate your holiday early for the above reasons you will be refunded part of the lodging costs based on the time remaining of the booking. This will be the full extent of the liability of the owners.  No additional compensation, expenses or costs will be payable.
  13. BREAKAGES: The Hirer is obliged to pay for any loss or damage beyond fair wear and tear. The Owners accept that accidents do sometimes happen and any charge will be at the Owners’ discretion.
  14. HIRER’S RESPONSIBILITIES: The Hirer is required at all times to keep the hired premises in a clean and tidy condition, to leave the hired premises in a clean and tidy condition on departure, to prevent any member of his party from causing a nuisance or disturbance to other guests or occupiers in the neighbourhood, to make the hired premises secure if left unoccupied during the period of let and do nothing else which might invalidate the Owners’ insurance policy. Items of furniture, glassware, china, crockery, cutlery or cooking utensils may not be moved between hired premises. In the event of a problem arising, the owners retain the right to require the Hirer and their party to leave and/or to make a charge of £30 for excessive cleaning if such cleaning is deemed necessary.
  15. ELECTRIC HEATING: Heating in the accommodation takes the form of controllable electric heating. The Hirer must not cover these heaters in any circumstances as it is a substantial fire hazard to do so.

  17. PETS: Pets cannot be accommodated in any lodges. If the Hirer arrives with pets the owners will exercise their right to require the Hirer and their party to leave and their stay will be void and non-refundable.
  18. SMOKING: Smoking and candles are not permitted inside the hired premises or any other building. Without exception the owners will exercise their right to require the Hirer and their party to leave if any person is deemed to be smoking or to have smoked within the hired premises or other buildings. Smoking is permitted within the grounds but please dispose of your cigarettes or cigars responsibly.
  19. FIRES: Fires of any sort are not permitted anywhere within the grounds so as to preserve the natural woodland that Burnbank Lodges is built within. Without exception the owners will exercise their right to require the Hirer and their party to leave if any person is found to be starting fires.
  20. BARBECUE: Barbecues are not permitted anywhere on balconies, patios or in the grounds due to fire risk and damage they cause.
  21. ELECTRIC CAR CHARGING: We do not currently have electric car charging facilities on site. The Hirer is not permitted to charge an electric car from internal sockets of hired premises. If the Hirer is found to have charged their car from a socket on site, the owners will exercise their right to require the Hirer and their party to leave and their stay will be void and non-refundable.
  22. OWNERS LIABILITY: The Hirer undertakes to relieve the Owners from any liability for damage or injury however caused by any member of his party. The Owners, their agents or employees accept no responsibility for loss, injury or damage to any member of the Hirer’s party, to their property or vehicles, howsoever caused, arising in any manner out of the let of the premises.
  23. RIGHT OF ENTRY: We shall be allowed reasonable right of entry to the property at all reasonable times for purposes of inspection or to carry out any necessary repairs or maintenance.
  24. ELECTRICAL EQUIPMENT OR FIRE SAFETY EQUIPMENT: The Hirer must inform the Owner if any electrical, or fire safety equipment develop faults during the stay.
  25. SHORTCOMINGS: Every effort is made to ensure that you have an enjoyable stay. However, if you have any problem or cause for complaint, it is essential that you contact us immediately to give us the chance to resolve it. We value your custom and want you to return. We are on site, and will do our best to resolve any problem. We cannot accept liability in relation to any shortcomings or claim of whatever nature if you fail to notify us of any complaint or claim during your holiday and write to us within 28 days of the end of your holiday. Most problems are easily and quickly resolved. If we are not given the opportunity to resolve the issue at the time of your visit, we will not consider a request for refund / remediation following departure.
  26. INTERNET: Free WiFi is available in your lodge. Due to the layout and location of the site the signal can be intermittent at times. However, we do have a very good 4G signal.
  27. GUEST LOYALTY CARD: All guests receive a Guest Loyalty Card on their first visit to Burnbank Lodges, regardless of which booking platform they make their booking through. However, stamps are only given on subsequent stays booked directly with Burnbank Lodges. Stamps cannot be collected for subsequent bookings made via online travel agents. The Loyalty card has no monetary value.
  28. GUEST LOYALTY SCHEME: Guests receive one stamp in their Guest Loyalty Card for each night they stay at Burnbank Lodges. Once 14 stamps have been collected the named person on the card is entitled to one free night on their next stay. This free night can be added on to any stay of three nights or more. Free nights cannot be used in conjunction with special offers. The loyalty card must be mentioned at the time of booking in order to claim the free night. There is no time limit for collecting or redeeming stamps. 
  29. SPECIAL OFFERS: Throughout the year the Owners run Special Offers. These offers are only valid on new bookings made within the stated time frame of the offer. The offer cannot be used in conjunction with any other special offer or Guest Loyalty Scheme free night offer.
  30. GIFT VOUCHERS: Burnbank Gift vouchers can be used as part, or full payment for a stay at Burnbank Lodges and can only be redeemed once. The voucher is valid for 12 months from the date of purchase. The vouchers cannot be used in conjunction with any other special offers or Guest Loyalty Scheme free night offers. Gift vouchers have a monetary value of £0.001
  31. DIGITAL REGISTRATION FORM: All guests will be asked to complete a digital registration form.
  32. SELF-ISOLATING: In line with UK Hospitality guidelines for Scotland, anyone presenting themselves during their stay at Burnbank Lodges with symptoms of COVID-19 or are asymptomatic but need to self-isolate must notify Us. They should check-out of Burnbank Lodges and return home to self-isolate according to the latest Government advice if reasonably possible. If for any reason it is not possible to return home, and self-isolation must take place at Burnbank Lodges, then all fees for all bookings affected by this self-isolation, and your extended stay will be borne by you.
  33. LOCAL TRAVEL RESTRICTIONS: In the event that the local area in which the guest resides, or the area that We are in, face Government restrictions on travel, We reserve the right to reschedule or cancel bookings.
  34. THE BURNBANK PROMISE: For all lets booked with Us directly, we offer The Burnbank Promise. If after the first nights stay the Hirer is not completely satisfied with their lodge and its surroundings We will refund the Hirer in full and also help to find alternative accommodation. 
  35. GENERAL: In the event that any individual term or clause stated in these Terms and Conditions of Let is not permissible by law, the remainder of the agreement shall remain valid.
