1. The Hirer warrants that the subjects let are to be used for the purposes of a holiday and so accepts that the letting is a holiday let to which Section 12(2) and paragraph 8 to Schedule 4 of the Housing (Scotland) Act 1988 apply, namely, "a tenancy the purpose of which is to confer on the tenant the right to occupy the house for a holiday."
  2. The Hirer shall not sub-let the premises or any part thereof.
  3. The number of people occupying the premises shall not exceed the number stated for the premises. If this rule is flouted, the Landlord has the right to ask the Hirer to leave. There will be no exceptions to this rule.
  4. The Hirer binds and obliges himself to vacate the hired premises without demand at the termination of the period of hire, i.e before 10am on the day of departure as noted on the invoice/receipt.
  5. The Hirer binds and obliges himself to pay to the Lessor in respect of any loss or damage beyond fair wear and tear.
  6. A deposit is payable at the time of booking which enters the tenant into a binding contract, this deposit is non refundable.
  7. Cancellation The deposit is non refundable. The Hirer will be liable for the total hire charge unless 30 days written notice is sent by recorded delivery to the Lessor. And if cancellation is within a calendar month of the start of the holiday, then the full amount will be due.
  8. The Lessor may treat the booking as cancelled if the balance of the payment is not sent by the date agreed on the invoice/receipt.
  9. The Hirer shall, at all times keep the hired premises in a clean and tidy condition.
  10. The Hirer shall undertake to prevent any member of his party from causing a nuisance or disturbance to other residents or occupiers in the neighbourhood. In the event of a problem arising, the Landlord has the right to ask the Hirer to leave. The Hirer undertakes to leave the hired premises secure if left unoccupied during the period of let and do nothing else which might vitiate the Landlord’s Insurance Policy.
  11. The Hirer undertakes to relieve the Lessor from any liability for damage of injury however caused by any member of his party.
  12. The Lessor, his agents or employees, accept no responsibility for loss, injury or damage to any member of the Hirer's party of their property, howsoever caused, arising in any manner out of the let of the premises.
  13. Dogs are welcome by prior arrangement, (max 2 - no puppies) subject to the following:
    a) must not be left in the lodge alone at any time.
    b) must be kept on leads in the grounds.
    c) must not be allowed on furniture. Owners must provde a suitable bed for the dog(s) and protections for carpets.
    d) all fouling cleared up and binned.
    e) any 'accidents' inside the lodge must be reported to the landlord immediately.
    if there is any excess mess in the lodge, the landlord reserves the right to make an extra charge for cleaning.
  14. There is a NO SMOKING and NO CANDLES policy inside the lodges, if this is not adhered to, the Landlord has the right to ask the Hirer to leave.
